RULES FOR THE EXERCISE OF AMATEUR FISHING

IN THE WATERS OF PUSIANO LAKE (CO)

Year 2013

Fishing on Pusiano Lake agrees with this regulation, as well as with national, regional and provincial instructions regarding fishing.
On  Pusiano Lake is prohibited any form of professional fishing.

The amateur fishing on Pusiano Lake is allowed only to those who are in possession of fishing permit issued by the Company Egirent Srl in addition to the regular possession of governmental license.

The residents of the coastal municipalities, of Lake Pusiano, should have the card required by the Company Egirent Srl equal to € 10 per year, for fishing from the shore.

Anyone who will be found without this badge will be required to pay the amount of the daily permit fishing.

All other forms of fishing will have to pay regular fishing permit fixed by the Company Egirent srl.

2.  FISHING FROM THE SHORE - EXEMPTIONS PAYMENT RIGHTS

Children up to 16 years and people over 70 years, residents of municipalities bordering the Lake Pusiano, are exempted from payment of the permit, however, they must be in possession of the government license.

3.  FISHING FROM THE SHORE

From January 1st 2013 fishing from the shore will be directly managed by Soc. Egirent s.r.l.

Fishing from the shore is allowed to all those in possession of Government license and permit, the payment will be made, according to the various proposals issued by the Company Egirent s.r.l.

4.  FISHING FROM THE BOAT or BELLYBOAT

Fishing from the boat or bellyboat is permitted only to holders of paid government licenses and permits, issued by the Company Egirent s.r.l. it is forbidden to use the depth sounder during the fishing action and have it on board.

For every boat is allowed the use of 2 rods for angler, for maximum 6 rods per boat on fishing.

The use of Tirlindana is prohibited from February 15 to May 31 (10 natural bait).

It is absolutely prohibited to tie-up to the warning buoys fish restocking areas, identified in yellow and properly marked with words on them. Violators will be punished with the immediate withdrawal of the permit.

Important: all holders of a fishing permit with a boat are allowed to fish from the shore without any further permission/cost.

5.  CARPFISHING

Permitted from January 1st to  December 31^st in only one mode "NO KILL" - with a total prohibition of holding the fish: and then banned the use of the bag for the maintenance of the fish.

Carp Fishing is allowed only to the holders of government license and permit issued by the Company Egirent s.r.l.

The maximum stay in fishing place is two weeks.

It is allowed only fishing in the bottom with lowered lines.

Carp fishing during daylight hours is only allowed if you are launching.

The use of the boat or other forms of watercraft is allowed during the day only to reach the fishing place and for the chum.

During the activity of chum and search for spot it is prohibited to have the rods on board.

During the night the use of the boat it is only allowed to bring the bait on the fishing place and for the recovery of the fish.

 The place of chum will be indicated by a buoy showing the name, last name and permit number (or subscription) of the owner of the fishing permit.

On the fishing place it is required the use of appropriate tents ( Carpfishing tents) colored green or mimetic max 2 places with absolute prohibition of placing canopies.

On the fishing place it is forbidden to light fires and leave trash or other materials. The place of fishing must be duly cleaned after use and materials removed.

In case of breaking the rules the agents of ecological guard of  Parco Valle Lambro will be communicated.

On the fishing place you must keep decent attitude in respect of the nature, of the round-up places and of other users of the banks and the waters of the lake.

The use of relevant fishing places is managed through booking service compulsory from Egirent srl.

Once the fishing place is booked its impossible to take back possession without proper authorization issued by Egirent srl.

Violation of the above described rules will result in the immediate withdrawal and cancellation of the fishing permit without compensation throughout the year.

6.  FISHING WITH THE SQUARE

It is not allowed the use and possession of the balance (square), violators will be punished with immediate withdrawal of the fishing permit and cancellation of the fishing permit without compensation throughout the year.

7.  ISSUING PERMITS FOR FISHING

Fishing permits (as established in points 1, 2, 3 and 4) are issued by the Company Egirent s.r.l. The acquisition of the fishing permit from the Company Egirent srl implies on total acceptance to this regulation of fishing.

In case the Regulation is not accepted there won’t be any possibility to release the fishing permit.

The fishing permit is nominal and it couldn’t be passed to the third parties.

8.  PROHIBITED PERIODS, NUMBER OF FISH ALLOWED AND MINIMUM MEASURES

Violation of the above described rules will result in the immediate withdrawal and cancellation of the fishing permit without compensation throughout the year.

9.  FISHING OF EXOTIC UNDESIRED SPECIES

The undesired species in Pusiano are following:

Crusian (Carassius carassius)

Catfish (Ictalorus melas)

Roach (Rutilus rutilus)

Sheatfish (Silurus glanis)

Pike perch (Stizostedion)

These species can be caught without any catch limit. The specimens belonging to these species, once caught, may not be reintroduced in water, but must be removed and not abandoned on the fishing place.

10.  SPECIAL PROHIBITIONS

-          Access to the private properties without authorization to reach the fishing spots.

-          Tie-up, damage and remove the warning buoys for fish restocking areas, fixed in the lake and properly marked.

-          It is prohibited to create own fish restocking areas of any type and size.

-          It is prohibited unauthorized fish input of any kind.

-          Egirent fish restocking areas are properly marked with yellow floating buoys including number label on them.

-          Nobody is authorized to manage them, modify them or do any other operation without authorization by the Company Egirent.

-          All boats can navigate only with electric motor or be oar boats.

-          Any type of intervention which is not authorized by the Company Egirent is prohibited.

The Company Egirent srl declines each civil or criminal responsibility, damage to persons or things that result as violation of the rules according to this Regulation as well as National, Regional and Provincial Regulation.

Violation of the above described rules will result in the immediate withdrawal and cancellation of the fishing permit without compensation throughout the year.

11.  SPECIFIC SANCTIONS  BY EGIRENT SRL

In case of violation of the rules and current regulations the Company Egirent s.r.l is in possess to withdraw the fishing permit of the holder, which will be subject to this measure even in the case where the violation is performed by other fishermen on the boat of the permit holder, without obligation of repayment or compensation whatsoever.

The permit will be returned after a period of suspension not less than 15 days, unappealable established  by the Company Egirent s.r.l. with a possibility of revocation of the same for an indefinite period of time depending of the infringements.

In any case of violation of the regulation in force that has led to the capture or killing of abusive fish fauna or other damages assessed, the Company Egirent s.r.l. will be sure to ask the responsible for the compensation of damages which will include the burdens of reinjection of the fish and the eventual recovery of the environmental damage caused.

Damage or removal of warning buoys showing the indication “woodshed natural “ will give the right to the Company Egirent s.r.l. to request the responsible for the compensation which will include the costs of repairing damage caused.

It is the right of the Company Egirent s.r.l not to grant the undesirables or repeat offenders with fishing permit.

12.  SURVEILLANCE AND INVESTIGATION OF OFFENSES

The surveillance will be performed by Provincial Security and by voluntary staff authorized by the Company Egirent srl.

Agents of the Provincial Police and the forces of law and order may also provide verification of the infringements.

Each owner of the fishing permit issued by the Company Egirent srl agrees and clears away the control of the residence permit and the governmental license as well as documentation  from the part of the volunteer staff authorized (equipped with identification card) of the Company Egirent srl.

In case of refusal to show this documentation to the volunteer staff of the company Egirent srl, the fishing permit will be immediately withdrawn and canceled without reimbursement of the same.

At the time of the withdrawal of the fishing permit, its signature for acceptance of the same has validity also as acceptance without any reserve of the above regulation.

Every kind of information about the fishing activities within Pusiano Lake can be communicated or released exclusively by the Egirent srl staff  in possession of recognition badge.

Navigation within Pusiano Lake will be communicated or released exclusively by the Egirent srl staff  in possession of the appropriate identification card.

No one else is granted this right.

In case of infringement there will be prosecution to the fullest extent of the law.
